| 1. Preliminary |
| 1.1. Access Canberra provides and administers the ACT Land Information System (“ACTLIS”) on this site. 1.2. ACTLIS provides access to the register and is the system for registration of all transactions relating to the purchase, sale and other dealings in relation to interests in land and properties located in the Australian Capital Territory. 1.3. Your use of ACTLIS is governed by these terms and conditions. By using ACTLIS, You agree to be bound by these terms and conditions. If You or Your organisation have an Account with Access Canberra in relation Your use of this site, then You or Your organisation may be subject to further conditions in relation to Your use of this site (“Additional Terms”). 1.4. Access Canberra administers ACTLIS, and handles any personal information that You provide through your use of ACTLIS, in accordance with the ACT Government Privacy Statement available here. 1.5. We may amend these terms and conditions at any time by publishing an updated version of these terms and conditions on this site. Any amendment to these terms and conditions is effective at the date of publication and You agree to such amendments by using or continuing to use ACTLIS. |
| 2. Definitions |
| 2.1. In these terms and conditions, unless the context otherwise requires: 2.1.1. “Access Canberra” means the business unit of that name within the Chief Minister, Treasury and Economic Development Directorate; 2.1.2. “Account” means an account established with Access Canberra to obtain invoices for services provided on this site; 2.1.3. “ACTLIS” has the meaning given in clause 1.1; 2.1.4. “Additional Terms” has the meaning given in clause 1.4; 2.1.5. “Australian Capital Territory” when used: 2.1.5.1. in a geographical sense, means the Australian Capital Territory; and 2.1.5.2. in any other sense, means the body politic established by section 7 of the Australian Capital Territory (Self-Government) Act 1988 (Cth); 2.1.6. “the register” means the land titles register referred to in section 43 of the Land Titles Act 1925; 2.1.7. “this site” means actlis.act.gov.au. “We” or "Us” means the Australian Capital Territory, represented by Access Canberra, and “Our” has the corresponding meaning; and 2.1.8. “You” means: 2.1.8.1. the person using this site and bound by these terms and conditions; and 2.1.8.2. if Your organisation is an Account holder (as a subscriber), Your organisation; as the context requires, and “Your” has the corresponding meaning. |
| 3. Changes |
| 3.1. We may change or discontinue any feature on or accessible through this site at any time, including Your ability to conduct any transactions, site content, hours of availability, pricing and equipment required for access. We will make reasonable efforts to notify You of any material changes, including through notices on this site. |
| 4. Fees |
| 4.1. Subject to any Additional Terms and unless otherwise notified, all relevant fees and taxes (such as transaction costs and goods and services tax) are payable at the time of submitting Your transaction, application, request or payment. |
| 5. Availability |
| 5.1. This site utilises Internet based technology and We do not guarantee that Your access to this site will be uninterrupted. 5.2. We have no control over the speed of transmission of data You experience where You access this site using the Internet. This is dependent on external factors, including Your Internet service provider. 5.3. We will use reasonable endeavours to provide access to this site at all times. However, there may be interruptions to services to facilitate urgent and reasonable maintenance. 5.4. Scheduled maintenance periods are required to ensure the viability of this site. We will make reasonable efforts to notify You of any scheduled outages, including through notices on this site. |
| 6. Use of ACTLIS |
| 6.1. You are permitted to use ACTLIS for the purpose of accessing the register and obtaining copies of titles, crown leases, plans, deeds and instruments held in the register. 6.2. You are not permitted to access or use ACTLIS for any of the following: 6.2.1. any activity in connection with this site that is unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic, profane, including activity that could give rise to any civil or criminal liability under the law; 6.2.2. the transmission of any viruses, worms, defects, trojan horses, or any items of a destructive nature; and 6.2.3. any use that interferes with the proper operation of this site, ACTLIS and the register, as determined by Access Canberra. |
| 7. Liability |
| 7.1. To the extent permitted by law, We are not liable for any loss, damage or injury (whether in contract, tort or otherwise, and including without limitation indirect, consequential, punitive or special damages, loss of data or loss of profit) arising as a result of: 7.1.1. Your use or reliance on this site or material available through this site (including without limitation inaccurate information); 7.1.2. any inability to access this site, including interruptions to the site for reasons beyond Our control; or 7.1.3. third party claims against You relating to Your use of this site or any other hyperlinked sites. 7.2. You are liable to Us for any breach of these terms and conditions, in tort and where liability arises under legislation. |

| 8.1. We do not represent that material or services in this site are appropriate or available for use in countries outside Australia. If You choose to access this site from outside Australia, You are responsible for compliance with foreign and local laws. |

| 12.1. These terms and conditions are governed by and interpreted in accordance with the laws of the Australian Capital Territory in Australia. You agree to submit to the jurisdiction of the Australian Capital Territory in relation to these terms and conditions. |
| 13. Entire agreement |
| 13.1. These terms and conditions, together with any Additional Terms that You have agreed to, constitute the entire agreement between You and Us in relation to this site, and supersede all prior representations, agreements, statements and understandings, whether verbal or in writing. 13.2. Where You have agreed to Additional Terms, in the event of any inconsistency between these terms and conditions and the Additional Terms, the Additional Terms prevail. |
| 14. Severability and waiver |
| 14.1. Any provision of these terms and conditions that is illegal, void or unenforceable will not form part of these terms and conditions to the extent of that illegality, voidness or unenforceability. The remaining provisions of these terms and conditions will not be invalidated by an illegal, void or unenforceable provision. 14.2. Nothing in these terms and conditions will be taken to be waived except by Our prior written agreement. |
